| The regular scheduled meeting
of the Marietta Borough Council convened
at 7:00 PM, Tuesday February 9, 1999 in
the Marietta Borough Council Chambers, 113 East Market
Street, Marietta, PA 17547. In
attendance were: President Lehman,
Councilwoman Fletcher, Councilmen Shireman, Armold,
Haugh, and Ellsworth; Mayor Overlander, and
Solicitor Hohenadel. |

| President Lehman called
the meeting to order followed by a
brief moment of silence and the pledge
of allegiance to the flag. |
|
|
|
|
| President Lehman presented
the minutes of the January 12, 1999
meeting. Councilman Ellsworth made
a motion to accept the minutes as
presented. Councilman Shireman seconded,
motion carried. |
|
|
|
|
| Mayor Overlander presented
Scout Masters, Bud Evans, Duane Aldridge
and George Kuhn with a proclamation
announcing February 7th through 13th as
Boy Scout Week in the Borough of
Marietta. |
|
|
|
|
| President Lehman stated
the first order of business would be
to select and appoint a new councilperson.
Mr. Eugene Smith and Mrs. Lori Nau
have both applied for the position
and both are eligible having met the
criteria. Councilwoman Fletcher stated
since there was not an vacancy committee
could we possibly review the candidates
as to who they are and their
qualifications. President Lehman stated
both candidates are long-time residents of
the borough, both have lived in the
borough for a minimum of one (1)
year to meet the residency requirement
and both candidates are registered voters.
President Lehman stated Mrs. Nau lives
on Bridge Street and Mr. Smith lives
on Longenecker Avenue. Mr. Smith
is a retired state trooper and Mrs.
Nau works at Rutter's Farm Store and
is involved in MYAA. Councilwoman
Fletcher stated it is her recllection
that Mr. Smith has presented himself
with candidacy in the past and one
of his educational qualifications is a
masters degree in public administration.
Councilwomen Fletcher also stated when he
presented himself before for candidacy, he
brough with him a petition with 131
signatures of registered voters in Marietta
supporting him. President Lehman
asked if anyone had anything else to
add concerning the qualifications of the
candidates. Solicitor Hohenadel stated
someone should place each of the candidates
names in nominations and each nomination
should be second. |

| Councilman Shireman made
a motion to nominate Eugene Smith,
Councilwoman Fletcher second. Councilman
Haugh made a motion to nominate Lori
Nau, Councilman Ellsworth second.
Councilman Shireman made a motion to
nominate Eugene Smith, Councilwoman Fletcher
second. President Lehman asked
for any other nominations. Roll
call vote was taken with the following

Mayor Overlander broke
the tie with a vote for Lori
Nau

| Councilman Ellsworth made
a motion to move that Council resolve
to appoint Lori J. Nau as a member
of Borough Council to fill the vacant
seat created by the resignation of
Councilman Harry Stotler for a period
of ten months. Councilman Haugh
second. Roll call vote was taken
with the following results: |

| Mayor Overlander swore in
Lori J. Nau. President Lehman
stated Mrs. Nau will chair streets
and highways. |

|
| PUBLIC COMMENT/SESSION |
|
|
|
|
| Mark Davis, 336 East
Market Street, stated no criticism to
Mrs. Nau at all, however he felt
that we have in Mr. Smith an
unusually qualified candidate; thirteen (13)
years in administrative experience, master
candidate in administration, and several
certificates for leadership. Mr. Davis
stated this strikes him as the best
person for the job looking at his
qualifications. Mr. Davis also
commented that Mr. Smith only lost
to Mr. Haugh in the election by
six (6) votes. |

| Corinna Yohe, 464 East
Market Street, stated on behalf of
the Marietta Jaycees, they would like
to ask for permission of Council to
use the War Memorial Park to hold
their 43rd Annual Stay at Home, 4th
of July celebration from June 28th
through July 5th, 1999. The
celebration will be held from June
30th through July 3rd, 1999.
Councilman Ellsworth made a motion to
grant Marietta Jaycees use of the War
Memorial Park for their 4th of July
celebration from June 28, 1999 to July
5, 1999, Councilman Haugh second, motion
carried. President Lehman stated
we will use the same procedures as
in the past, please forward a copy
of the certification of insurance to
the office. Councilman Ellsworth
asked Mrs. Yohe to thank the Marietta
Jaycees from the Borough Council for
the work they do. |

| Jesse Wagner, 606 East
Market Street, stated after reading the
minutes from last months meeting, he
noticed the Mayor did address the Y2K
issue with EMS. However, since
he did bring this issue up with
the Mayor, the President, and Safety
and Health Councilman, Mr. Haugh, Mr.
Wagner feels he is under the impression
that all three (3) of you are
referring to Y2K as a problem as
to will the Borough be able to
operate by computer, etc. Mr.
Wagner stated even though he is concerned
about the Borough, he is more concerned
about fire and ambulance services.
Mr. Wagner acknowledges that PA is
one of the best states that is
Y2K compliant. Mr. Wagner stated
his main concern is the citizens of
all ages living in the Borough of
Marietta. There needs to be
a plan the Borough has that may
or may not work in conjunction with
the County, State or Federal plans
so that the citizens themselves are
protected if there is a need
for food, water, sewage, heat, etc.
President Lehman stated the Borough's computers
are Y2K compliant, EMA is on board
and also the fire company.
President Lehman stated if there are
any glitches, it may perhaps be with
the 911 system and they are presently
working on that. Mr. Wagner
stated Council is missing the point.
What could happen? Mr. Wagner
asked about the computer that runs
one of the fire company's engines,
how about home heating systems, gas
lines that have implants, even automobiles
from 1988 and under. Mr.
Wagner stated individual home lives, not
only business or Borough, may be affected.
Mr. Wagner asked the Borough to form
a committee to investigate what may
be affected. Councilwoman Fletcher
stated C-Span is regularly giving advise
in terms of social security as to
people getting hard copies of all their
qualifications, etc. Councilwoman Fletcher
stated the media is informing people
of how to protect themselves, particularly
their investments. |
